Houston Personal Injury Attorney With an Insurance Adjuster’s Perspective

Serious personal injury cases in Texas rarely involve just one legal issue. Alongside questions of fault and damages, most cases also involve an insurance company deciding how much your claim is worth and how quickly or slowly it gets paid. Understanding both sides of that equation is central to how Herrera PLLC approaches every case.

Before earning his J.D. from South Texas College of Law Houston, Jonathan Herrera spent over a decade working as a licensed insurance adjuster, founding and operating JH Claims LLC, a multi-state independent adjusting firm. He later practiced insurance defense at Rymer, Echols, and Nelson-Archer before opening Herrera PLLC to represent injured individuals and families instead.

Understanding Serious Personal Injury Claims

A serious personal injury claim generally involves harm significant enough to affect a person’s health, income, or daily life in a lasting way, including injuries requiring surgery, extended treatment, or long-term care.

Herrera PLLC represents clients across a range of matters, including:

How Insurance Affects Your Claim

Nearly every personal injury case involves an insurance company at some stage, whether it’s the at-fault driver’s auto insurer, a property owner’s liability policy, or a commercial trucking company’s coverage. Insurance companies often use internal guidelines to estimate what a claim is worth, and those figures don’t always reflect the full extent of a person’s medical needs, lost income, or long-term impact. Because Jonathan Herrera spent years evaluating claims from the inside, first as an adjuster and later as insurance defense counsel, he has firsthand familiarity with how carriers assess injury claims and how settlement discussions typically unfold. Texas Legal Considerations

Texas law imposes a general two-year statute of limitations for most personal injury claims, and two years from the date of death in wrongful death cases. Claims against a government entity generally require written notice within six months. Texas also follows a modified comparative negligence rule: an injured person can recover compensation even if partly at fault, as long as they are not found more than 50 percent responsible, with any award reduced by their percentage of fault.

No Fees Unless We Win

Herrera PLLC handles serious injury cases on a contingency fee basis. There’s no upfront cost, and you owe nothing in attorney’s fees unless compensation is recovered. The firm advances case-related costs and is reimbursed only if the case succeeds.

Personal, Direct Attorney Involvement

Herrera PLLC operates as a boutique practice with a deliberately selective caseload. Jonathan Herrera personally handles client matters rather than delegating them to associates or support staff, and the firm provides service in both English and Spanish.

Jonathan Herrera, J.D. is the founder of Herrera PLLC in Houston, Texas. Before practicing law, he spent over a decade as a licensed insurance adjuster and later practiced insurance defense, experience he now applies on behalf of injured individuals and families across Texas.
