Personal Injury Lawyer in Katy

by Jonathan Herrera, J.D. Founder, Herrera PLLC

Personal Injury Lawyer in Katy, Texas

Katy has grown faster than almost anywhere else in the Houston region, and the roads, job sites, and neighborhoods haven’t always kept pace with that growth. New subdivisions keep pushing west and south, freight trucks move steadily along I-10 toward the Energy Corridor and beyond, and construction crews are a constant presence around the Grand Parkway interchanges. With that much activity comes a steady stream of serious accidents — and the insurance companies behind them.

Jonathan Herrera represents injured residents of Katy and the surrounding communities across Harris, Fort Bend, and Waller counties. Before he was a plaintiff’s attorney, he spent more than ten years on the insurance side of the table: investigating claims, founding his own independent adjusting firm, and working in insurance defense litigation. He has seen firsthand how carriers decide what a claim is “worth,” and he uses that knowledge for his clients instead of against them.

Serving Katy, Harris / Fort Bend / Waller County Local Risks Near I-10 & the Grand Parkway

Katy sits at the crossing point of two of the busiest transportation corridors in Texas. Interstate 10 carries a constant flow of commuter and commercial traffic through the heart of the city, while the Grand Parkway (SH 99) brings a steady stream of regional freight and through-traffic from Cypress, Sugar Land, and beyond. Where the two intersect, congestion, lane changes, and high speed differentials combine to produce some of the area’s most serious wrecks.

Beyond the freeways, Katy’s rapid residential and commercial expansion has its own set of hazards. New developments off Katy-Fort Bend Road, Pin Oak Road, and the Westpark Tollway extension bring heavy construction traffic and shifting lane patterns that catch drivers off guard. Cinco Ranch, Cane Island, and the neighborhoods around LaCenterra at Cinco Ranch see frequent fender-benders that turn serious when a distracted driver fails to stop in time. And because much of Katy sits in floodplain-adjacent terrain, the years since Hurricane Harvey have brought a wave of construction and renovation projects — meaning more work crews, more equipment on shoulders and easements, and more risk for everyone sharing the road.

Because Katy spans three counties, where a claim gets filed often depends on exactly where the incident happened. Cases arising in the city may fall under Harris County, Fort Bend County, or Waller County jurisdiction, and each has its own district courts, county courts at law, and Justice of the Peace precincts. Identifying the correct venue early — and naming every liable party correctly matters for how a case proceeds and how quickly it can resolve.

Hospitals and emergency care serving the Katy area:

  • Memorial Hermann Katy Hospital: the area’s Level III Trauma Center, equipped to stabilize patients and transfer them to a higher level of care when needed
  • Houston Methodist West Hospital: full-service hospital serving West Houston and Katy
  • Texas Children’s Hospital West Campus: pediatric emergency and trauma care
  • Memorial Hermann–Texas Medical Center: the nearest Level I Trauma Center for the most critical injuries

For a life-threatening emergency, call 911 first. Legal questions can wait until you or your loved one is stable.

Injuries We Handle in Katy

Katy’s mix of interstate traffic, growing job sites, and busy retail corridors means injuries here come from many different directions. A serious wreck on I-10 or the Grand Parkway can leave a driver with fractures or worse, especially when a commercial truck is involved and the speed differential is severe. Construction tied to the area’s growth and post-storm rebuilding adds another layer of risk, from job-site falls to incidents on shifting, poorly marked roadways.

How Fault & Damages Work in Texas

Texas applies a modified comparative fault standard, found in Civil Practice and Remedies Code Section 33.001. A person found 51% or more at fault for their own accident cannot recover anything. Anyone found 50% or less at fault still recovers, but the award is reduced by their own percentage of responsibility.

That single rule shapes nearly everything an insurance adjuster does after a Katy-area accident. Every point of fault they can shift onto you is a point they don’t have to pay. This is why early statements, photos, and witness accounts matter so much in the days right after a crash.

Texas law allows recovery for both economic and non-economic harm. Economic damages cover medical bills (past and projected future costs), lost income, and reduced future earning capacity. Non-economic damages account for pain and suffering, mental anguish, physical impairment, and disfigurement. In rare cases involving gross negligence, exemplary damages may also apply.

Where a Katy-area case is filed depends on the county of jurisdiction and the amount in controversy. Larger claims generally proceed in district court, while smaller matters may be heard in county courts at law or a local Justice of the Peace precinct in Harris, Fort Bend, or Waller County. Primary courthouse locations include the Harris County District Courts at 201 Caroline Street, Houston, TX 77002; the Fort Bend County Courthouse at 301 Jackson Street, Richmond, TX 77469; and the Waller County Courthouse at 836 Austin Street, Hempstead, TX 77445. Claims against a government entity including the county or a public agency carry a six-month written notice requirement that must be met before any lawsuit can be filed. Texas imposes a strict two-year statute of limitations on personal injury claims. Limited exceptions may apply for minors, claims against government entities, and certain latent injuries.

What Insurers Do After Your Injury

The moment a claim is reported, the insurance company assigned to it begins working and not necessarily in your favor. A few patterns show up again and again in Katy-area claims:

An adjuster calls quickly and asks for a recorded statement, often presenting it as a routine formality. It isn’t one, and you’re not required to give one to the other party’s insurer before speaking with an attorney.

A fast settlement offer arrives before the full extent of injuries or future treatment needs is even known. Once that offer is accepted and a release is signed, the claim is closed for good, even if new symptoms appear later.

Independent Medical Examinations, scheduled with a physician chosen and paid by the insurer, frequently come back downplaying the necessity or extent of treatment. And throughout the process, adjusters look for any inconsistency in the record that can be used to push a larger share of fault onto the injured person, reducing what the carrier ultimately owes.

Why a Former Insurance Adjuster Represents You

Many personal injury lawyers have only ever worked from the plaintiff’s side of a case. Jonathan Herrera spent over a decade on the other side first investigating and evaluating litigated casualty and property claims for insurance carriers, then running his own independent adjusting firm across Texas.

That background means he isn’t guessing how a carrier will respond to a Katy-area claim. He has set reserves, reviewed defense strategy, and seen which evidence moves a case toward a fair settlement versus prolonged litigation. He keeps a selective caseload so that clients work directly with him throughout their case, not primarily with support staff.
