Serious Injury

Personal Injury Lawyer in Houston

by Jonathan Herrera, J.D. Founder, Herrera PLLC | Former Insurance Adjuster

Personal Injury Lawyer in Houston, Texas

A serious injury can change your life in an instant. One moment you are driving to work on the I-10, crossing the street near the Texas Medical Center, or doing your job on a Houston worksite. Next, you are dealing with medical treatment, missed income, vehicle damage, and insurance companies that are working to limit what they pay you. At Herrera PLLC, we believe injured Texans deserve personal commitment backed by proven experience.

Texas is an at-fault state. In theory, the person who caused your injury and their insurance company should compensate you for your losses. In practice, obtaining fair compensation is rarely that simple.

Insurance companies handle thousands of claims every year. Their adjusters are trained to resolve cases quickly and for as little money as possible. The difference between an insurer’s first offer and the true value of a claim can be significant.

Herrera PLLC proudly provides bilingual representation in English and Spanish. Houston’s Latino community deserves direct communication with its attorney rather than relying on a third-party translator. If Spanish is your primary language, you can discuss your case directly with Jonathan Herrera.

How Fault and Damages Work in Texas

Texas Modified Comparative Fault

Texas follows a modified comparative fault rule under Texas Civil Practice and Remedies Code Section 33.001. The practical effect is straightforward but consequential: if you are found 51 percent or more responsible for an accident, you cannot recover any damages. If you are 50 percent or less at fault, your recovery is reduced by your share of responsibility.

This rule is exactly why insurance adjusters work so hard in the days immediately after an accident to assign fault to the injured person. Every percentage point they push onto you reduces what they owe. Protecting the evidence, avoiding recorded statements, and framing the facts accurately from the start are not optional; they determine the value of your case.

What You Can Recover

Texas allows injured people to pursue both economic and non-economic damages. Economic damages cover the concrete financial losses: past and future medical expenses, lost wages, reduced earning capacity, and property damage. Non-economic damages cover what the numbers do not fully capture: physical pain and suffering, mental anguish, physical impairment, and disfigurement. In cases involving gross negligence a drunk driver, a company that ignored known safety hazards exemplary (punitive) damages may also be available.

Where Your Case Is Filed in Harris County

Cases seeking over $200,000 in damages are typically filed in Harris County District Court. Cases valued at $200,000 and under may be filed in Harris County Civil Courts at Law. Smaller property damage disputes may be handled in Justice of the Peace Court. Harris County courts handle a substantial volume of civil litigation every year. Understanding where a case belongs and how local courts operate is an important part of building an effective litigation strategy. Knowing which court fits your case and which judges handle high-volume personal injury dockets is part of building the right litigation strategy from day one.

The Two-Year Deadline

Texas imposes a two-year statute of limitations on most personal injury claims. That clock generally starts running on the date of the accident. Waiting too long means losing the right to sue entirely, regardless of how strong your case is. There are limited exceptions for minors, for cases involving government entities, and for some latent-injury situations but none of them should be relied on without counsel.

What Insurers Do After Your Injury

The moment your accident is reported, the insurance carrier on the other side starts building its file. That file is not built in your favor.

  • The Recorded Statement
Adjusters often call within hours or days, framing a recorded statement as a routine formality. It isn’t. You are under no obligation to give a statement to the at-fault driver’s insurer, and anything you say can later be used to dispute your claim. Speak with an attorney first.
  • The Early Settlement Offer
Insurers move quickly to get a signed release before you have a clear picture of your injuries or future medical needs. Once you sign, the claim is closed for good, regardless of how your condition develops afterward.
  • Challenging Medical Treatment
Carriers frequently order Independent Medical Examinations performed by physicians of their own choosing. These exams often conclude that treatment was unnecessary or excessive. Having reviewed these evaluations from the carrier side, Jonathan Herrera knows how they are built and how to push back on them.
  • Maximizing Your Share of Fault
Under Texas’s modified comparative fault rule, every percentage point of blame shifted onto you reduces what the insurer has to pay. Adjusters are trained to comb accident reports for inconsistencies and frame the facts accordingly. Locking down the evidence early is what limits this tactic.

Why a Former Insurance Adjuster Represents You

Most personal injury attorneys have spent their entire careers on the plaintiff side. They understand what cases are worth, and they know how to negotiate and litigate. What they have never done is sit in the room where insurers evaluate cases from the inside, reviewing reserves, assessing litigation exposure, and deciding how aggressively to fight a claim.

Jonathan Herrera has been in that room.

Before founding Herrera PLLC, he spent over a decade investigating and evaluating high-exposure litigated casualty and property claims for insurance carriers. He later founded an independent adjusting firm, working across carriers and claim types throughout Texas. That experience produced a working understanding of how insurers think not as abstract adversaries, but as organizations with specific internal processes, evaluation frameworks, and pressure points.

What that means in practice:

When Jonathan reviews your case, he is not guessing at how the carrier will respond. He knows what factors adjust the reserve, what defenses will be raised early, and what evidence if gathered quickly shifts the carrier’s calculus toward meaningful settlement rather than prolonged litigation. He knows which arguments move adjusters and which ones do not. He knows when an offer reflects real case value and when it is an opening lowball position.

He also maintains a selective caseload by design. Every client at Herrera PLLC receives direct, personal attention from Jonathan not a paralegal hand-off or a case manager. That selectivity means he can prepare each case the way it deserves to be prepared, whether the right approach is an early strategic resolution, aggressive pre-litigation negotiation, or trial preparation from day one.

Herrera PLLC provides bilingual representation in English and Spanish. Houston’s Latino community, the largest demographic group in Harris County deserves access to a lawyer who communicates directly in Spanish without relying on a translator for substantive conversations about your case.

No Fee Unless We Win

Herrera PLLC handles personal injury cases on a contingency fee basis. That means:

  • No upfront retainer. You do not pay anything to hire us.
  • No hourly billing. You will never receive an invoice for attorney time.
  • No fee unless we recover. Our fee is a percentage of the amount we recover for you. If there is no recovery, there is no fee.

This structure exists because people who have been injured dealing with medical bills, missed work, and an uncertain recovery should not have to pay out of pocket to access quality legal representation. It also aligns our incentives completely with yours. We are motivated to maximize your recovery because our fee depends on it.

At your free consultation, Jonathan will explain exactly how the contingency fee works, what percentage applies to your type of case, and how costs are handled. There are no surprises.
