Personal Injury Lawyer in Greater Heights 77008

By Jonathan Herrera, J.D. | Herrera PLLC.

Personal Injury Lawyer in Greater Heights (77008)

Greater Heights sits just north of I-10 and west of Loop 610 close enough to downtown that commuters use it as a cut-through, active enough with new construction and restaurant development that foot and bicycle traffic has surged, and old enough that its housing stock takes the full force of every hail and windstorm that rolls through Harris County. All three of those things produce injury claims. All three produce disputes with insurance companies.

Jonathan Herrera takes personal injury cases in Greater Heights and throughout Harris County. His background is different from most plaintiff-side attorneys: before law school, he spent over a decade investigating and evaluating high-exposure casualty and property claims for insurance carriers, then built and ran his own independent adjusting firm. That experience sits on your side of the table now.

Serving Greater Heights (77008) Incidents Near I-10 Katy Freeway and N Shepherd

The I-10 Katy Freeway defines the southern edge of Greater Heights and is one of the widest and most heavily travelled urban highways in the country. The on- and off-ramp interchanges between Shepherd Drive, Durham Drive, and the West Loop are among its most congested and crash-prone segments. A wrong-way driver on I-10 eastbound near Washington and Westcott just south of the Heights boundary struck a Tesla Cybertruck head-on and killed two people. Separately, ABC13 and KHOU have documented multiple-vehicle crashes on the Katy Freeway near the West Loop, including an ejection that left one person hospitalized. These are not anomalies; they reflect the baseline risk on a freeway carrying over 200,000 vehicles per day.

North Shepherd Drive and Durham Drive are the Heights’ primary north-south arterials. A city traffic engineering study documented more than 1,000 crashes and two deaths on these two roads in just over three years, prompting the Memorial Heights Redevelopment Authority to undertake a multi-year reconstruction project that explicitly cited the crash rate and lack of pedestrian access as the driving reason. That project is still underway. Active construction zones on Shepherd and Durham continue to create hazards: lane shifts, temporary signals, uneven pavement, and reduced sightlines at intersections.

Yale Street and 19th Street carry the residential and commercial traffic that defines daily life in the neighborhood. Hail and windstorms routinely damage the older bungalows and craftsman homes throughout 77008 and when they do, insurers regularly dispute whether damage is storm-related or pre-existing, delay inspections, and offer settlements that fall well short of actual repair costs.

How Fault and Damages Work in Texas

Under Texas Civil Practice and Remedies Code Section 33.001, Texas applies a modified comparative fault rule. Recovery is possible as long as the injured person is no more than 50 percent at fault but every percentage point of fault assigned to you reduces your compensation by the same amount. At 51 percent or above, recovery is cut off entirely.

In practice, insurers have a built-in financial incentive to dispute how the accident happened and maximize the fault attributed to you. Protecting the factual record early before statements are given and before evidence disappears is one of the most consequential things an attorney can do in the days immediately after an injury.

Recoverable damages include past and future medical costs, lost earnings and reduced earning capacity, physical pain, mental anguish, physical impairment, and disfigurement. Where the at-fault party acted with gross negligence, exemplary damages may also be available.

Harris County personal injury cases are generally filed in Harris County District Court for claims exceeding $200,000. Claims between $10,001 and $200,000 are typically handled in the Harris County Civil Courts at Law, while claims of $10,000 or less are generally filed in Justice of the Peace Court. Texas’s statute of limitations for most personal injury claims is two years from the date of the accident. Missing that deadline can forfeit the right to pursue compensation regardless of how clear liability may be. Limited exceptions may apply for minors, claims against government entities, and certain latent injuries.

What Insurers Do After Your Injury

Speed is the insurance company’s first tool. Adjusters reach out quickly after an accident, and those early contacts are designed to shape the claim in the carrier’s favor before the injured person has had time to understand what happened or what they are entitled to.

A recorded statement request typically comes first. It sounds administrative, it is not. The goal is to capture your account of the accident and your injuries at the earliest possible moment, before your medical picture is complete and before you have legal advice. You have no obligation to provide one to the other driver’s insurer.

A settlement offer often follows shortly after. Early offers are not made out of goodwill; they are made to get a release signed before the full extent of your medical needs is known. Once signed, the claim is permanently closed.

When treatment costs accumulate, carriers frequently arrange an Independent Medical Examination with a physician they select. Those exams routinely minimize injury severity or challenge the necessity of treatment. Jonathan Herrera has sat on the carrier side of this process and knows exactly how to challenge these reports with treating physician records and independent expert testimony where needed.

Texas Insurance Code Section 542 creates enforceable deadlines and financial penalties for carriers that delay claims without cause. Knowing those rules and invoking them changes the dynamic.

Why a Former Insurance Adjuster Represents You

What separates Jonathan Herrera from most personal injury attorneys is not a litigation style it is a decade of direct experience inside the insurance claims process before he ever practiced law.

He spent that time evaluating high-exposure litigated casualty and property claims for insurance carriers, then built and ran his own independent adjusting firm across multiple insurers throughout Texas. He later worked in insurance defense litigation before switching to plaintiff-side representation. The result is an attorney who understands not just what a case is worth but how the carrier is calculating it, what internal benchmarks they are applying, and which moves will shift a case toward meaningful resolution.

Every client at Herrera PLLC works directly with Jonathan. He keeps a selective caseload so that no file gets handled by a paralegal while the attorney is busy elsewhere.

No Fee Unless We Win

Herrera PLLC handles personal injury cases on a contingency fee basis. There is no upfront retainer, no hourly billing, and no out-of-pocket cost to retain the firm. The fee is a percentage of what is recovered if there is no recovery, there is no fee.
