Personal Injury Lawyer in Downtown, 77002
Personal Injury Lawyer in Downtown (77002)
Downtown Houston packs office towers, sports venues, hotels, and a dense residential population into a few square miles, all connected by sidewalks, garages, and one of the most complicated freeway interchanges in the state. That density is what makes the neighborhood work, but it also means pedestrians, rideshare passengers, garage users, and drivers navigating the interchange are all sharing tight space with heavy commercial and commuter traffic at nearly every hour of the day. Insurance companies that write policies covering downtown properties and vehicles are used to defending claims out of this ZIP code, and they do not make it easy on the person who got hurt.
Jonathan Herrera represents injured residents, workers, and visitors throughout Downtown Houston and the 77002 area. Before practicing law, he spent more than a decade on the insurance side, adjusting claims, building his own independent adjusting firm, and later working in insurance defense litigation. Herrera PLLC’s office sits just east of downtown in the EaDo neighborhood, close enough that Jonathan knows this part of the city firsthand, not just from a case file.

Serving Downtown (77002), Incidents Near the I-45/I-69 Spaghetti Bowl
The interchange where I-45 and I-69 meet just north and east of downtown is known locally as the Spaghetti Bowl, and the name is not an exaggeration. Multiple elevated levels, tight merge points, and heavy truck and commuter volume make this one of the most crash prone stretches of freeway anywhere in Houston. Drivers entering or exiting downtown through this interchange face sudden lane drops and merging traffic moving at highway speed, conditions that regularly produce multi vehicle collisions and serious injury crashes.
Inside the core of downtown itself, the risks look different. Pedestrians crossing at Main Street, Travis Street, and the busy intersections near Discovery Green and the Toyota Center face constant turning traffic from drivers navigating one way streets and parking garage entrances. Rideshare pickups and drop offs along these same corridors add another layer of risk, with vehicles stopping suddenly in travel lanes to load and unload passengers.
Commercial high rises throughout downtown also generate their own category of claims. Slip and fall incidents in office lobbies, parking garages, and retail concourses are common, and building owners and their insurers often dispute whether a hazard was properly maintained or whether adequate warning was given before an incident occurred.
Downtown claims are filed in Harris County. Depending on the value of the case, that means Harris County District Court, the Harris County Civil Courts at Law, or a local Justice of the Peace precinct.

How Fault & Damages Work in Texas
Texas applies a modified comparative fault rule under Civil Practice and Remedies Code Section 33.001. A person found 50% or less at fault for an incident can still recover compensation, reduced by their own percentage of fault. Once fault reaches 51% or more, recovery is barred entirely.
In a downtown setting, that rule gets applied in some fairly specific ways. A pedestrian struck while crossing mid block, or a driver merging through the Spaghetti Bowl at the wrong moment, can expect an insurer to argue they contributed to what happened. Building owners facing a slip and fall claim often argue the hazard was open and obvious, or that the injured person was not paying attention. Documenting the scene, getting witness information, and having an independent investigation done early makes it much harder for these arguments to stick.
Damages in a Texas personal injury case fall into two general categories. Economic damages cover medical bills already incurred and expected in the future, lost income, reduced future earning capacity, and property repair or replacement costs. Non economic damages account for pain and suffering, mental anguish, physical impairment, and disfigurement. Where a defendant acted with gross negligence, such as drunk driving, exemplary damages may also be available.
Court selection depends on the amount at stake: cases above $200,000 generally proceed in Harris County District Court, cases between $10,001 and $200,000 in the Harris County Civil Courts at Law, and cases of $10,000 or less in Justice of the Peace Court. Most personal injury claims must be filed within two years of the incident. Claims involving minors, claims against a government entity, and injuries that were not immediately apparent can affect that deadline, and government related claims may carry a notice requirement as short as six months.
What Insurers Do After Your Injury
As soon as a claim is reported, the insurance company assigned to it starts building a file, and that file exists to protect the carrier, not the person who got hurt.
Expect an early call asking for a recorded statement, presented as a routine step in processing the claim. It is not required, at least not to the other party’s insurer, and giving one before you have spoken with an attorney rarely works in your favor.
A quick settlement offer often follows, timed to arrive before the full extent of your injuries is known. Once you sign the release that comes with it, the claim is closed for good, even if complications develop later.
If treatment continues, the carrier may schedule an Independent Medical Examination with a physician of its own choosing, and these exams have a track record of downplaying injuries or questioning whether treatment was necessary. For premises liability claims involving downtown buildings, adjusters often argue that maintenance logs show no prior notice of a hazard, or that security footage does not support the claimant’s account. Jonathan has reviewed claim files like these from inside a carrier, and knows how to push back with the right documentation and independent experts.
Why a Former Insurance Adjuster Represents You
Most personal injury attorneys have only ever represented plaintiffs. Jonathan Herrera spent his first career on the other side, investigating and evaluating casualty and property claims for insurance carriers, then running his own independent adjusting firm across Texas before he ever practiced law.
That experience is directly relevant downtown, where premises claims against commercial building owners and complex multi vehicle collisions at the Spaghetti Bowl both require understanding how a carrier evaluates liability and exposure. Jonathan has set claim reserves, sat in on defense strategy discussions, and seen firsthand what evidence actually moves a case toward a fair resolution. He also keeps his caseload small, so clients work directly with him instead of being handed off to support staff.

You owe nothing unless we recover for you. Evidence disappears, witnesses become harder to find, and the two year statute of limitations keeps running whether you act or not. Certain claims involving minors, government entities, or injuries that surface later may follow different rules. The sooner you reach out, the stronger your position.
